The terms under which Cosmic KPI is provided.

These Terms of Service ("Terms") are an agreement between you and Cosmic KPI ("Cosmic KPI," "we," "us," "our"), a sole proprietorship operating from the State of Georgia, United States, which operates cosmickpi.com and the Cosmic KPI application (together, the "Service").
Cosmic KPI is a precision instrument for astrology: it computes planetary positions from the Swiss Ephemeris, measures them against a birth chart you enter, and presents the result as indicators, timelines, calendars, and notes you can inspect. These Terms cover how you may use it, what you can expect from us, and what happens if something goes wrong.
The Privacy Policy explains what information the Service collects and how it is handled. It is part of these Terms by reference.
Please read Section 17 carefully. It requires most disputes to be resolved by individual arbitration rather than in court and waives your right to participate in a class action, unless you opt out within 30 days.
By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You may explore parts of the Service without an account, using a sample chart or a chart you enter in your browser. These Terms apply to that use as well.
We may change these Terms as the product changes; Section 19 explains how you will be told and what happens if you disagree.
You must be at least 18 years old. The Service is intended for adults and we do not knowingly provide it to anyone under 18.
The Service is currently offered to users in the United States only. If you use it from elsewhere, you do so on your own initiative and are responsible for complying with your local law.
If you accept these Terms on behalf of an organization, you confirm that you have the authority to bind it.
You agree to give accurate account information and to keep it current. One person should hold one account; do not share your account with others.
Cosmic KPI is an instrument, not an oracle. It calculates: planetary positions, aspects to your natal chart, timing windows, and a transit-pressure indicator derived from them. The astronomy is computed from the Swiss Ephemeris and is as accurate as that ephemeris and the birth details you provide. The meaning you take from it is yours to make.
The Service is provided for personal, informational, and entertainment purposes only.
Cosmic KPI does not provide professional advice of any kind. Nothing in the Service is medical, psychological, psychiatric, legal, financial, investment, tax, insurance, employment, relationship, or other professional advice, and nothing in it should be treated as a diagnosis, a prognosis, a prediction of events, or a recommendation to take or avoid any action. It is not a substitute for consulting a qualified professional, and you should never disregard or delay professional advice because of something you read here.
Decisions are yours. You are solely responsible for any decision you make or action you take, and for any consequence of it, whether or not you consulted the Service first. We make no promise that any outcome, result, event, or benefit will occur.
If you are in crisis, please get help from a person, not an app. In the United States, call or text 988 (Suicide & Crisis Lifeline), or call 911 in an emergency. Cosmic KPI is not a crisis service, is not monitored, and cannot respond to emergencies.
You are responsible for everything that happens under your account and for keeping your credentials secure. Choose a password you do not use elsewhere, and do not let anyone else use your account.
You may create your account with an email address and password, or by signing in with Google. If you sign in with Google, your ability to reach your account depends on that Google account remaining available to you.
Tell us promptly at hello@cosmickpi.com if you believe your account has been accessed without your permission. We are not liable for losses arising from unauthorized use of your account before you tell us.
You keep ownership of what you enter. Your birth details, chart labels, notebook entries, evidence verdicts, Connections information, and imported calendar events remain yours ("Your Content").
You grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, copy, transmit, and display Your Content — solely to operate, secure, and support the Service for you, including computing results, publishing the calendar feeds you ask for, and creating backups. This license exists only so the Service can function; it ends when you delete the content or your account, apart from copies retained briefly in backups. We do not use Your Content to train machine learning models and we do not sell it.
Information about other people. Connections and calendar imports can hold details about people who are not our users. By entering another person's information you confirm you have any consent or authority required to do so, and you are responsible for that. See the Privacy Policy for how we handle it.
Accuracy is yours. Results are computed from what you enter. An incorrect birth time, date, or place produces confident results that are wrong, and we cannot detect that for you.
Keep your own copies. You can ask for a complete export of your data at any time (see the Privacy Policy). We are not a system of record for anything you cannot afford to lose.
The Service has a free plan and a paid plan. The free plan is offered as-is and may change. The paid plan unlocks additional features, which are described in the app and may be adjusted as the product develops.
Prices. The current price, the billing interval, and any applicable taxes are shown in the app before you subscribe. Prices are stated in U.S. dollars. No price is stated in these Terms, so that what you see at checkout is always the operative one.
Nothing is charged unless you complete checkout. If paid checkout is not yet open in your account, no payment can be taken and no card is on file.
Payment processing. Payments are processed by Stripe, not by us. Your card details go directly to Stripe and we never see or store your full card number. Stripe's own terms apply to that processing.
Automatic renewal. Paid plans are subscriptions: unless you cancel, your plan renews automatically at the end of each billing interval and the payment method on file is charged the then-current price for that plan. You authorize that recurring charge when you subscribe.
Price changes. We may change subscription prices. If we do, we will tell you by email before the change takes effect for you, and the new price applies from your next renewal. If you do not want to pay it, cancel before that renewal.
Failed payments. If a charge fails, we may retry it and may suspend paid features until payment succeeds. You are responsible for keeping a valid payment method on file.
You can cancel at any time. Cancellation stops the next renewal and takes effect at the end of the billing period you have already paid for. Your paid features remain available until that period ends, and your account then continues on the free plan.
Refunds. Payments are not refundable, including for a partial billing period, for time you did not use the Service, or after a plan is cancelled or downgraded, except where a refund is required by law. This does not affect any statutory rights you have that cannot be waived. If you believe you were charged in error, email hello@cosmickpi.com and we will look into it.
What a downgrade does — and does not — do. Dropping to the free plan locks the paid features; it does not delete your data. Saved charts you already have stay in your account and remain editable; the plan limit applies only when you create a new one. Published calendar feeds and syncs that depend on paid features stop updating.
If we end your paid plan. If we discontinue the paid plan entirely, or terminate your subscription for a reason other than your breach of these Terms, we will refund the unused portion of the period you have paid for.
We sometimes issue promotional codes that grant paid features for a limited period. Redeeming a code does not require a payment method, cannot charge you, and does not start a subscription. When the period ends, the account returns to the free plan on its own; nothing renews.
Codes are personal, have no cash value, cannot be resold or transferred, and may be limited in number or expire. We may cancel a code that is shared publicly, redeemed abusively, or issued in error.
Use the Service for your own research and reflection. You agree not to:

The Service — its software, interface, design, charts and visualizations, interpretation and research text, documentation, and the underlying models and methods — is owned by Cosmic KPI and protected by copyright and other laws. "Cosmic KPI" and "Key Planetary Indicators," together with the Cosmic KPI logo, are our marks; do not use them without permission.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial purposes, and to use the results it generates for you, including sharing individual charts, reports, or exports. Everything not expressly granted is reserved.
Feedback. If you send us ideas, suggestions, or bug reports, we may use them freely and without obligation to you. We will not identify you as their source without your permission.
Third-party components. The Service incorporates third-party software, including the Swiss Ephemeris, and data from OpenStreetMap. Those components remain subject to their own licenses.
Some features connect the Service to companies we do not control — Google Calendar if you choose to publish your forecast, Google Sign-In if you use it, Stripe for payments, and OpenStreetMap's Nominatim for looking up birth places. Calendar feeds you subscribe to, and .ics files you import, come from sources of your own choosing.
Your use of those services is governed by their terms and privacy policies, not ours. We are not responsible for their availability, accuracy, or acts, and a change on their side may change or end a feature here. The Privacy Policy sets out exactly what is shared with each of them.
Cosmic KPI is an actively developed product. We may add, change, or remove features, adjust how indicators are computed, or alter what each plan includes. Where a change materially reduces a paid feature you rely on, we will give notice by email or in the app.
We do not promise uninterrupted or error-free operation. The Service may be unavailable for maintenance, for third-party outages, or for reasons outside our control, and calendar feeds and syncs may be delayed or fail.
If we discontinue the Service entirely, we will give you reasonable advance notice and a period in which to export your data, and we will handle any paid subscription as described in Section 7.
You may stop at any time. You can stop using the Service, cancel a subscription in your account settings, or ask us to delete your account entirely at hello@cosmickpi.com.
We may suspend or terminate your access if you materially breach these Terms, if your use puts the Service, its infrastructure, or other users at risk, if we are required to by law, or if your payment method fails and remains unresolved. Where the circumstances allow it, we will warn you first and give you a chance to put it right.
What happens then. On termination, your license to use the Service ends and your content is deleted as described in the Privacy Policy. Sections 5, 10, and 14 through 20 survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free; that results, calculations, timing windows, or interpretations will be accurate, complete, or suitable for any purpose; or that any outcome will follow from using it. Astronomical calculations are accurate only to the limits of the underlying ephemeris, timezone data, and the birth details you enter. Nothing you obtain from the Service creates a warranty not stated in these Terms.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, COSMIC KPI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE — INCLUDING ANY DECISION YOU MAKE OR ACTION YOU TAKE BASED ON IT — WHETHER THE CLAIM IS IN CONTRACT, TORT, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED, IN THE AGGREGATE, TO THE GREATER OF (a) THE AMOUNT YOU ACTUALLY PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS.
These limits are a fundamental part of the agreement between us and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the least extent permitted by law.
You agree to indemnify and hold harmless Cosmic KPI and anyone acting on its behalf from claims, damages, liabilities, and reasonable legal costs arising out of your use of the Service, Your Content, your breach of these Terms or of any law, or your entry of another person's information without the authority to do so. We will notify you of any such claim and you may control its defense, provided any settlement that imposes an obligation on us needs our agreement.
Talk to us first. If you have a problem, email hello@cosmickpi.com with a description of it and the resolution you want. Most things are fixable this way. Both of us agree to try in good faith to resolve a dispute informally for 60 days before starting arbitration.
Binding individual arbitration. If that does not resolve it, you and Cosmic KPI agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Georgia or, at your election, by telephone, video, or on written submissions. The arbitrator decides all issues except that a court decides whether this arbitration agreement is enforceable. The Federal Arbitration Act governs it.
Class-action waiver. Disputes will be brought only in your or our individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding. You and Cosmic KPI waive the right to a jury trial. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
Small claims. Either of us may instead bring an individual claim in small-claims court if it qualifies.
Your 30-day right to opt out. You can decline arbitration and this class-action waiver. Email hello@cosmickpi.com with the subject line "Arbitration Opt-Out," including the email address on your account, within 30 days of first accepting these Terms. Opting out costs you nothing, changes nothing else in these Terms, and will not affect your account in any way; Section 18 then governs where disputes are heard.
Time limit. Any claim relating to the Service must be brought within one year after it arises, or it is permanently barred, unless applicable law forbids that limit.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration under Section 17, you and Cosmic KPI submit to the exclusive jurisdiction of the state and federal courts located in Georgia, and each waive any objection to venue there.
We may update these Terms as the Service changes or the law requires. The "last updated" date at the top always reflects the current version.
If a change is material — for example to billing, to Section 15, or to Section 17 — we will notify you in the app or by email before it takes effect, and it will not apply retroactively to a dispute that already exists. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and, if you have a paid plan, cancel it (Section 7).
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Cosmic KPI about the Service, and replace any earlier understanding about it.
Severability. If a provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
No waiver. Not enforcing a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither of us is liable for a failure to perform caused by events beyond reasonable control, including outages at our hosting or payment providers.
Electronic communications and notices. We may send notices to the email address on your account or display them in the app, and you agree that electronic notices satisfy any legal requirement that a notice be in writing. Notices to us go to hello@cosmickpi.com.
No third-party beneficiaries. These Terms create rights only between you and us.
Relationship. Nothing here creates a partnership, employment, agency, or joint venture between us.
